Terms and Conditions and Complaints Procedure

1. Introductory Provisions

The following general terms and conditions apply to all orders placed by customers (hereinafter referred to as "you") through the website planetatriko.cz (hereinafter collectively referred to as the "Online Store").

By using planetatriko.cz and/or placing an order, you agree to be bound by these terms and conditions (hereinafter referred to as the "Terms"). Please ensure you have read and understood the Terms before placing your order. By purchasing from the Online Store, you enter into a contract with OPT OnDemand s.r.o., U Průhonu 13a, 170 00 Prague 7, Czech Republic, Company ID: 45312966, VAT ID: CZ 45312966, registered with the Municipal Court in Prague under file no. C 7384 (hereinafter referred to as "we"), the content of which is determined by these Terms.

The purchase contract can be concluded in the Czech language. Orders may only be placed by adults over 18 years of age who are not under guardianship and who are not placing orders for their business or self-employed activity or for the business or self-employed activity of a third party. Entrepreneurs within the meaning of § 420 of Act No. 89/2012 Coll., the Civil Code ("Civil Code") are not entitled to place orders. Please note that we do not issue tax documents within the meaning of § 28 of Act No. 235/2004 Coll., on Value Added Tax.

OPT OnDemand and its distributor reserve the right to limit various delivery areas during certain periods of the year. The inclusion of any products or services on planetatriko.cz at a particular time does not imply or guarantee that these products or services will be available at any time. We reserve the right to discontinue any product at any time.

We reserve the right to change these Terms from time to time without prior notice. The version of the Terms applicable to your order will be those displayed on planetatriko.cz at the time you place your order.

Website Protection and Proper Use

Our goal at Planetatriko is to provide the best possible online experience. To achieve this, it is essential to ensure that our services operate flawlessly. Therefore, we ask that you respect the following rules and understand that you agree not to:

  • Post, transmit, redistribute, upload, or promote any communication or content that could harm our reputation, products, services, or otherwise negatively affect the operation of our business. This includes any content that is illegal, offensive, defamatory, or infringes the rights of third parties.

  • Use any tools, devices, or mechanisms (including, without limitation, robots, crawlers, spiders, avatars, or other intelligent agents) that could disrupt the functionality or security of the website. Furthermore, you agree not to act in a manner that restricts, disrupts, interferes with, or otherwise prevents any other user from using or enjoying the planetatriko.cz website.

  • Use any automated systems or software tools that facilitate navigation or searching on the planetatriko.cz website, including attempts to copy content from individual pages without our express consent.

We reserve the right to immediately block access to the website and terminate the account of any user who violates any provision of these terms or engages in activity that threatens the security or integrity of our website or services.

2. Prices and Shipping Costs

Prices displayed on planetatriko.cz include statutory value-added tax but do not include delivery charges. The shipping cost for each order will be the same, regardless of the size or weight of your order. The price for each delivery method is clearly stated during the process. If we are unable to deliver your order in full and need to make more than one delivery, you will not be charged any additional fees for the extra deliveries. Prices in-store and online may differ.

3. Conclusion of the Purchase Contract

You can place orders through planetatriko.cz. After placing an order, if you have provided us with your email address, you will receive a confirmation email. The purchase contract, including the terms and conditions, is archived by the seller in electronic form and is not accessible.

If, for any reason, we are unable to fulfill your order, we will inform you at the earliest opportunity. If we have already received payment for such an order, we will attempt to refund the corresponding amount using the same method as the payment was made. If alternative arrangements are necessary for any reason, we will notify you and ask you to contact our customer service, which will handle the refund (see section 6. Complaints Procedure and Product Defects).

4. Delivery Conditions

Planeta Triko takes utmost care in receiving and processing orders and will endeavor to deliver your order in accordance with your selected delivery option. Planeta Triko aims to dispatch orders within 5 working days of receipt, and delivery occurs depending on your chosen shipping method, usually within 3–7 working days from dispatch. Although we strive to deliver within the specified timeframe, unexpected delays may occur. If the delivery time exceeds 30 days, you may cancel the order (see section 5. Right of Withdrawal).

Before submitting your order, you will be informed of the estimated delivery details. After placing the order, you will receive a confirmation email with information about the expected delivery.

5. Right of Withdrawal

According to § 1829 paragraph 1 of the Civil Code, you have the right to withdraw from the purchase contract within fourteen (14) days from the day you or a third party designated by you, other than the carrier, takes possession of the goods, or:

  • a) the last item of goods, if you order multiple items in one order that are delivered separately,

  • b) the last piece or part of a delivery of goods consisting of several items or parts, or

  • c) the first delivery of goods, if the contract provides for regular delivery of goods over a specified period.

You may withdraw from the contract by completing and submitting the sample form, which is attached as Annex 1 to these terms and conditions.

In the event of withdrawal from the purchase contract, the contract is canceled from the outset. You must send or hand over the goods back to us without undue delay, no later than fourteen (14) days from the withdrawal from the contract. The deadline is met if you send the goods before the expiration of this period. If you withdraw from the purchase contract, you bear the costs associated with returning the goods, even if the goods cannot be returned by ordinary postal means due to their nature.

In the event of withdrawal from the purchase contract, we will refund the received funds within fourteen (14) days from the withdrawal from the purchase contract, using the same method as the payment was made. We are also entitled to return the performance provided by you upon returning the goods, provided you agree and no additional costs arise for you. If you withdraw from the purchase contract, we are not obliged to return the received funds before we receive the returned goods or before you prove that you have sent the goods back, whichever occurs first.

Please contact customer service to discuss the best way to return the product to the company. Planeta Triko guarantees a full refund for any returned items, provided that all items are returned in the same condition as when received. This means that items should not be damaged, soiled, washed, altered, or worn (other than for trying on), and all labels or tags should be intact.

6. Complaints Procedure and Product Defects

We are responsible for ensuring that the product is free from defects upon receipt. You can report a defect that appears on the product within two years of receipt. If a defect appears within one year of receipt, it is presumed that the item was defective at the time of receipt, unless the nature of the item or defect excludes this. This period does not run during the time you cannot use the item if you have rightfully reported the defect.

If you receive a product that is in any way damaged, you may request delivery of a new item without defects or repair of the item, unless the chosen method of removing the defect is impossible or disproportionately expensive compared to the other; this is assessed particularly with regard to the significance of the defect, the value the item would have without the defect, and whether the defect can be removed by the other method without significant difficulties for you. You may be asked to provide reasonable proof of damage in the form of a photograph of the damaged product or to return the damaged product to the company.

We may refuse to remove the defect if it is impossible or disproportionately costly, especially with regard to the significance of the defect and the value the item would have without the defect. You may request a reasonable discount or withdraw from the contract if:

  • a) we have refused or failed to remove the defect in accordance with § 2170 paragraphs 1 and 2 of the Civil Code,

  • b) the defect reoccurs,

  • c) the defect constitutes a substantial breach of contract, or

  • d) it is evident from our statement or circumstances that the defect will not be removed within a reasonable time or without significant difficulties for you.

If you are entitled to claim for defective performance, you are also entitled to reimbursement of costs reasonably incurred in asserting this right, provided you assert this right within one month after the expiry of the period in which the defect must be reported.

7. Payment Terms

You can pay for your goods in various ways as listed below.

PAY NOW – You can pay by VISA, Mastercard, or AMEX card in any of our shipping countries.

You are required to provide the correct email address and inform Planeta Triko if your email address changes. Please note that Planeta Triko reserves the right to send payment requests to your email address. Please also note that we are unable to accept gift cards.

8. Limitation of Liability

Nothing in these Terms excludes or limits the liability of Planeta Triko with respect to any matter for which it would be unlawful for us to exclude or limit our liability. We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we will be liable only for losses that are a reasonably foreseeable consequence of such breach.

Planeta Triko shall not be liable for non-delivery of goods or for failure to fulfill any of our other obligations under these terms if such failure is caused by an event beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil unrest, war, nuclear accident, and terrorist activity.

9. Display of Colors and Product Features

We make every reasonable effort to accurately display the attributes of our products, including composition and colors. The color you see depends on your computer system, and we cannot guarantee that your computer will display such colors accurately.

10. Product Warranty

If the purchased product develops defects, Planeta Triko complies with all statutory warranty regulations. If you have a complaint regarding obvious material or manufacturing defects in the goods we have delivered, including damage caused during transport, please proceed in accordance with section 6 of the Terms.

11. Assignment of Rights

Planeta Triko reserves the right to assign or transfer to third parties any claim(s) for payment arising in connection with the delivery of goods.

12. Severability

If any part of these Terms is found to be prohibited or unenforceable by a court or regulatory authority, the remaining provisions will continue in full force and effect.

13. Intellectual Property Protection

All intellectual property rights such as trademarks and copyrights on planetatriko.cz remain with the licensor OPT OnDemand s.r.o. Any use of planetatriko.cz or its contents, including copying or storing such content in whole or in part, other than for your personal, non-commercial use, is prohibited without the permission of the licensor OPT OnDemand s.r.o.

14. Complaints

We care about your satisfaction. In case of dissatisfaction or other issues, please do not hesitate to contact us by email or telephone.

For out-of-court settlement of consumer disputes arising from the purchase contract, the Czech Trade Inspection Authority, based at Štěpánská 567/15, 120 00 Prague 2, Company ID: 000 20 869, internet address: https://adr.coi.cz/cs is competent. The online dispute resolution platform available at http://ec.europa.eu/consumers/odr may also be used to resolve disputes between the seller and the buyer under the purchase contract.
